David Alfaro is a Senior Managing Director at FTI Consulting, Inc. Over his 34-year career, Mr. Alfaro has led more than 300 engagements as an expert witness or as an expert consultant, nearly all of which have been in the investigations and disputes space.
Throughout his professional life, Mr. Alfaro has provided expert witness testimony in numerous matters involving alleged terrorist financing, breach of contract, misappropriation of trade secrets, breach of fiduciary duties, aiding and abetting a Ponzi scheme, theft, fraud, RICO and other similar allegations, which depended upon the recovery and analysis of financial, accounting, human resource, and operational data.
Mr. Alfaro is an expert in the areas of collecting enterprise-wide information with extensive experience in complex, data-intensive analyses in response to internal investigations, litigation, mass arbitrations, and government/regulator-driven inquiries. In this capacity, Mr. Alfaro has provided formal and informal testimony to Federal and State Courts, the Federal Trade Commission, the Consumer Financial Protection Bureau, the Federal Bureau of Investigation, the Securities and Exchange Commission, the Department of Justice, the U.S. Attorney’s Office, the Financial Industry Regulatory Authority, and other federal agencies.
As an investigator, fact-finder, and a data scientist, Mr. Alfaro has been twice designated and approved as a third-party neutral technical expert and advisor to the Court. He has also been approved by FINRA as the independent third-party examiner over a major financial institution to review and assess alleged violations of federal securities laws; and by the FTC as the independent data integrity monitor over a large financial services company to conduct biennial reviews of the company’s end-to-end operations, including their compliance programs, supporting ERP systems, as well as the investigation into ongoing complaints of alleged wrongdoing received by the FTC, the CFPB, State Attorneys General, and other Federal and State agencies related to allegations of fraud, overcharged fees, improper interest calculations and other debt servicing and credit reporting activities.
