CRL4 - Settle, Arbitrate, or Litigate? Stress-Testing Dispute Resolution Strategy
Description

This Crisis Response Lab will center around a hypothetical company that offers online services to connect patients with mental health providers, which gets sued out of the blue for capturing the personal information of visitors to the company’s website and disclosing the information to third party marketing services in order to further the company’s digital marketing strategies (so called “pixel tracking litigation.”).  The suit is brought on behalf of a proposed class of nationwide consumers and alleges violations of various consumer protection and privacy laws.  The company learns of the lawsuit after the plaintiffs’ lawyer calls asking for an early settlement.  Around this hypothetical, this Crisis Response Lab will explore various emergency response scenarios and how to handle the litigation, including the nature and timing of potential resolution and other related considerations.
