Why do businesses choose to mediate or arbitrate? The need to preserve relationships or reputations, save time and money costs and avoid Covid-19 backlogs mean that court litigation is often not the preferred course of action for businesses faced with a dispute. 

This session will ask in-house counsel from a variety of different industries how, when and why they decide not to litigate. Do they use mediation, or arbitration (or something else?). How do they gain stakeholder engagement for a different course of action? And once decided, how do they prepare?
