The debate on whether surrogacy should be allowed, if not at least recognized, is dividing not only the legal world but society itself. Many countries forbid surrogacy all together, and a lot of them do not even recognize the intentional parent as being a real parent at all. This topic gives rise to a number of issues, such as parental responsibility, heirship rights, maintenance rights and moral dilemmas. But maybe most importantly: how are lawyers supposed to write new wills and trust documents, in order to catch all potential beneficiaries (or adequately exclude them)?
