Description
Many (if not all) civil law countries provide for forced heirship. On the opposite side, most of the common law countries enforce almost full freedom of testation.
With modern families on the rise and new social structure and values with stray further and further away from the models upon which forced heirship has been built upon, a question begs for an answer: is forced heirship a valuable tool in today’s society? Do the values upon which it has been built be revised, or should it be abolished all together?
