One of the few things worse than being subpoenaed by a state attorney general is being subpoenaed by a coalition of state AGs working together and sharing resources to conduct a “multistate” investigation. A multistate action represents a serious threat to a company. A thoughtful and calculated response strategy needs to account for the unique nature of multistate investigations, which differ in critical ways from other investigations, as well as the individual AGs involved. A plan for responding to document requests, protecting confidential information, and negotiating a resolution, if possible, is also essential to minimizing reputational damage and avoiding outcomes that could require a company to fundamentally change its established business practices.
