Mismanaged internal investigations can lead to damaged reputations, financial loss and/or legal action. While many lawyers are well aware of the ethical considerations while dealing with litigation, some may not be aware of the ethics issues to consider during an internal investigation, which could lead to an ethical lapse when dealing with these situations. Ethical issues can arise at every stage of an internal investigation but anticipating these ethical issues and devising a strategy for minimizing risk will expedite and boost the credibility of the investigation. This session will focus on avoiding the pitfalls of a poorly handled internal investigation and include best practices for creating an investigative plan, conducting interviews, gathering evidence, anticipating and managing ethical risks, working with the compliance department and more. Decisions such as having a board-led investigation and when to self-disclose to the regulators will also be discussed.
